1. Definitions and Interpretation

In these Terms & Conditions:

1.1 "Client" refers to the individual or entity placing an order with Spike Trading ABN 22 682 624 157. 1.2 "Goods" means aluminum hardware and related products available for purchase from Spike Trading, as listed on its website, inclusive of GST, subject to availability and price changes without notice.

2. Ordering and Supply of Goods

  • 2.1 The Client may place an order ("Order") via the Spike Trading website, email, or phone.
  • 2.2 An Order constitutes an offer by the Client to purchase Goods in accordance with these Terms & Conditions.
  • 2.3 Spike Trading reserves the right to accept or decline any Order, in whole or in part. Acceptance is confirmed when the Goods are dispatched or made available for collection.
  •  2.4 Orders may only be canceled or modified before dispatch and require written approval from Spike Trading.
  • 2.5 No cancellations or modifications are permitted after dispatch.

3. Advertised Goods

  • 3.1 All products are subject to availability. Spike Trading is not liable for out-of-stock or discontinued items.
  • 3.2 We strive to ensure all information on our website is accurate and up to date. However, we reserve the right to correct errors and update details without prior notice.
  •  3.3 Product colors and details may slightly vary due to screen resolutions and manufacturing differences.
  • 3.4 If an advertised product is unavailable, Spike Trading may substitute it with a similar item of equal value.

4. Delivery and Collection

  • 4.1 Spike Trading may:
    • (a) Make Goods available for collection, or
    • (b) Deliver Goods to the Client's nominated address within standard business hours. 
  • 4.2 Delivery fees apply as advertised on our website and may change without notice.
  • 4.3 If the recipient is unavailable, the Goods may be left with another individual at the delivery location or in a safe place at our discretion.
  • 4.4 Incorrect or incomplete address details provided by the Client may result in additional delivery fees.
  • 4.5 The Client accepts responsibility for the Goods upon delivery or collection.
  • 4.6 Spike Trading is not liable for delays in delivery and is not responsible for loss or damage once the Goods are in transit.

5. Returns

  • 5.1 Returns for change of mind are not accepted. However, a credit voucher may be issued at our discretion if the item is returned in its original, unopened condition within 14 days of dispatch. Delivery fees are non-refundable.
  • 5.2 Claims for missing or damaged Goods must be noted on the delivery receipt and reported within 48 hours of receipt.
  • 5.3 If required, returns of defective items must be arranged using a tracked shipping method at Spike Trading’s expense.

6. Risk and Title

  • 6.1 Risk transfers to the Client upon collection or dispatch of the Goods.
  • 6.2 Title remains with Spike Trading until full payment is received.
  • 6.3 If payment is not made, Spike Trading may repossess the Goods and enter the Client’s premises to retrieve them.

7. Payment

Goods must be paid for in full before dispatch.

8. Default

  • 8.1 A Client is in default if payment is overdue or these Terms & Conditions are breached.
  • 8.2 In case of default, Spike Trading may: (a) Suspend further supply of Goods;
    • (b) Require immediate payment of outstanding amounts;
    • (c) Charge 10% interest per annum on overdue balances;
    • (d) Recover legal and collection costs.

9. Warranties and Liability

  • 9.1 Spike Trading excludes all warranties to the extent permitted by law.
  • 9.2 Where required by law, our liability is limited to:
    • (a) Replacement of the Goods; or
    • (b) Reimbursement of the purchase price.
  • 9.3 Spike Trading is not liable for loss of profit, business interruption, or indirect damages resulting from the use of our products.

10. Amendments

10.1 Spike Trading may update these Terms & Conditions at any time. The Client agrees to the updated Terms unless they object in writing within seven days of the change.

11. Jurisdiction

11.1 These Terms & Conditions are governed by the laws of New South Wales, Australia, and any disputes shall be subject to the jurisdiction of NSW courts.
